Welcome to Xylo Bikes, LLC. These Terms and Conditions (“Terms”) govern your use of our website and online store. By accessing or purchasing from xylobikes.com, you agree to abide by these Terms.

1. General Terms

These Terms apply to all visitors, users, and customers of our website.
We reserve the right to update or modify these Terms at any time.
By using our website, you confirm that you are at least 18 years old or have parental consent.
If you create an account on our website, you are responsible for maintaining the confidentiality of your login credentials.
You agree to notify us immediately of any unauthorized use of your account.
Xylo Bikes is not liable for any loss resulting from unauthorized account access.

2. Orders & Payments

All orders are subject to availability and acceptance.
Prices are listed in US dollars ($) and may be subject to taxes and shipping fees.
We accept Visa, Master Card, American Express, Discover and Affirm. Payments are securely processed by third-party payment providers.
Xylo Bikes reserves the right to cancel orders suspected of fraud or unauthorized transactions.
Custom and made-to-order bicycles may have longer fulfillment times. Estimated delivery times will be provided at checkout.
If we cannot fulfill an order due to stock issues or supply chain delays, we will notify you and offer the option to cancel for a full refund.

3. Shipping & Delivery

Shipping times may vary based on location, demand, and customization requirements. Standard fulfillment is estimated at 4 to 6 weeks for made-to-order bicycles.
Customers are responsible for providing accurate shipping details.
Title and risk of loss for all products pass to the customer upon delivery to the designated shipping carrier.
We are not responsible for delivery delays caused by external factors, including weather, customs processing, or carrier disruptions

4. Returns & Refunds

Our return policy allows for returns within 30 days of delivery in accordance with our Return Policy.
Returned items must be unused, in original packaging, and include proof of purchase.
Customers are responsible for return shipping costs unless the item is defective or incorrect.
Refunds will be processed within 5-7 business days after the returned item is received and inspected.
Custom-made or personalized bicycles are final sale and cannot be returned.
Clearance or final sale items are non-refundable.

5. Warranty & Repairs

Our wooden bicycles come with a 3-year limited warranty covering manufacturing defects in accordance with our Warranty Policy.
The warranty does not cover normal wear and tear, misuse, modifications, or improper maintenance.
Customers must report warranty claims within 30 days of discovering a defect and provide proof of purchase.
The warranty is valid only for the original purchaser and is non-transferable.
Warranty claims must be filed via info@xylobikes.com, and Xylo Bikes reserves the right to repair, replace, or refund at its discretion.

6. Limitation of Liability

Xylo Bikes, LLC is not responsible for accidents, injuries, or damages resulting from improper bicycle use, assembly, or maintenance.
By purchasing a bicycle from us, you acknowledge that cycling carries inherent risks, and you assume all liability for personal safety while riding.
We are not liable for any indirect, incidental, or consequential damages arising from product defects, website use, or purchase transactions.
Xylo bicycles are designed for recreational and general road use.
Using the bicycles for extreme sports, professional racing, or off-road stunts may void the warranty and result in damage not covered under warranty.

7. Intellectual Property

All content, images, and designs on our website are the property of Xylo Bikes, LLC and may not be used without permission.
Any unauthorized reproduction, distribution, or modification of our materials is strictly prohibited.
If you submit reviews, photos, or testimonials to our website or social media, you grant Xylo Bikes a non-exclusive, royalty-free, perpetual license to use this content for marketing or promotional purposes.

8. Privacy & Data Protection

We collect and use customer data in accordance with our Privacy Policy.
By using our store, you consent to the collection, processing, and storage of your of necessary data for order fulfillment and marketing purposes.
We do not sell customer data but may share it with trusted service providers for payment processing, shipping, and analytics.
You may opt out of marketing communications at any time.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the state of Delaware, USA.
Any disputes arising from these Terms shall be resolved through biding arbitration in the state of Delaware.
Customers agree to waive their right to a jury trial and participate in arbitration before filing a lawsuit.
Customers agree that disputes must be brought individually and not as part of a class action.
